Using a mixed methodology that combines documentary analysis of 247 ECtHR rulings, systematic review of updated doctrine and semi-structured interviews with 45 family law professionals, six critical areas are identified: the right of the child to be heard, international child abduction, foster care and adoption systems, recognition of parenthood, gender identity in minors and surrogacy. The results reveal a consolidated trend towards the evolutionary interpretation of Article 8 of the European Convention on Human Rights (ECHR), giving priority to the best interests of the child as the guiding principle. There is a 34% increase in convictions of States for violation of the right of the child to be heard, as well as a more restrictive jurisprudence in cases of international abduction.
