Das Problem des Dopings im Sport zählt gegenwärtig zu den brisantesten sportpolitischen Themen. Im Mittelpunkt der Diskussion um eine strafrechtliche Aufarbeitung dieser Materie stand stets der Aspekt des Gesundheitsschutzes. Inwieweit auch der strafrechtliche Vermögensschutz berührt ist, wurde bislang kaum behandelt. Dies verwundert, ist doch die Kommerzialisierung und Professionalisierung im Sport keine neue Erscheinung, sondern eine Entwicklung, die mit der Dopingproblematik einhergeht. Es sind deshalb die wirtschaftlichen Gesichtspunkte des Dopings, die den Kern der Abhandlung bilden: Der Autor untersucht betrugsrelevante Verhaltensweisen des gedopten Sportlers, wobei er vor allem hinsichtlich der Betrugskonstellationen zum Nachteil des Sponsors Neuland betritt. Die Arbeit schlie t mit der Erörterung eines gesetzgeberischen Handlungsbedarfs zum strafrechtlichen Schutz des Sportethos.

About The Author

Der Autor: Rainer Tarek Cherkeh, geboren 1968 in Gehrden, studierte Rechtswissenschaften in Göttingen. Erstes und zweites Staatsexamen 1994 und 1998. Seit April 1998 als Rechtsanwalt in einer wirtschaftsrechtlich ausgerichteten Kanzlei tätig. Promotion 1999. In der Folge wurde er als Berater der "European Group on Ethics" der Europäischen Kommission berufen, die zu ethischen Aspekten des Dopings im Sport im Oktober 1999 ihre Stellungnahme vorgelegt hat.
