Gegenstand der vorliegenden Arbeit sind aktuelle Fragestellungen aus dem Gebiet des Fundrechts, 965-984 BGB. Ausgehend von den Gesetzesmaterialien zum BGB werden Rechtsprechung und Literatur seit Entstehung des BGB bis heute untersucht und zur Beantwortung der aufgestellten Fragen aus dem Fundrecht fruchtbar gemacht. Dabei steht zunächst die Auslegung der in 965 BGB genannten Begriffe der verlorenen Sache und des Finders im Vordergrund. Es schlie t sich die Untersuchung des gesetzlichen Schuldverhältnisses aus Fund an. Besondere Aufmerksamkeit gilt dabei der Begrenzung der Haftung nicht voll geschäftsfähiger Finder. Untersucht werden weiterhin Fragen, die im Zusammenhang mit dem Eigentumserwerb des Finders an der Fundsache stehen.

About The Author

Die Autorin: Susanna Lins wurde 1965 in Frankfurt am Main geboren. Sie studierte ab Wintersemester 1984/85 Rechtswissenschaften an der Universität Gießen und legte 1990 die erste juristische Staatsprüfung ab. Nach einem einjährigen Studienaufenthalt an der juristischen Fakultät der Universität Parma (Italien) ist sie seit 1992 Rechtsreferendarin beim Landgericht Gießen.
