Das Gemeinderecht ist der Zustandigkeit des Bundesgesetzgebers ent- zogen. So bestehen trotz aller gemeinsamen Grundlagen in den einzelnen Bundeslandern groBe Unterschiede, die die Darstellung der Materie schwierig machen. Wenn der Verfasser sich dennoch an diese Aufgabe gewagt hat, so deshalb, weil er in zwanzigjahriger Tatigkeit als Hauptverwaltungsbeamter und Burgermeister in vier verschiedenen Bundeslandern praktische Erfah- rungen sammeln konnte und durch seinen Wohnsitz in einem funften Bundes- land auch mit dessen Gemeinderecht vertraut ist. Ein Lehrauftrag der Uni- versitat Mannheim und die Schriftleitung einer kommunalen Zeitschrift halten ihn zudem in standiger Verbindung mit den Fragen der Praxis. Fur die Darstellung boten sich zwei Moglichkeiten. Es konnte entweder nacheinander das Gemeinderecht jedes einzelnen Bundeslandes dargestellt werden, was zwangsweise zu zahlreichen Wiederholungen gezwungen hatte, oder die Materie muBte yom Grundsatzlichen her angefaBt und jeweils auf landesrechtliche Abweichungen verwiesen werden. Das schien mir der richtige Weg zu sein, zumal er das Gemeinsame gegenuber dem Trennenden hervor- hebt. Urn die Verweisungen nicht allzu umfangreich werden zu lassen, habe ich bei Gemeindeordnungen, die eng miteinander verwandt sind, wie z. B. der saarlandischen und der rheinland-pfalzischen oder der Bremerhavener und der hessischen, die in der kleineren Korperschaft geltende Regelung nur erwahnt, wenn sie ausnahmsweise von der in der verwandten Gemeinde- ordnung geltenden Regelung abweicht. Da das Buch nicht nur zum Studium, sondern auch als Nachschlagewerk Verwendung finden soIl, ist sein Gebrauch durch regelmaBige Verweisung auf andere Textstellen erleichtert worden. Dem gleichen Zweck dient auch das Schlagwortverzeichnis.
