Wissenschaftlicher Aufsatz aus dem Jahr 2004 im Fachbereich Jura - Medienrecht, Multimediarecht, Urheberrecht, Sprache: Deutsch, Abstract: Im Jahre 1972 produzierte das ZDF ein Dokumentarspiel mit dem Namen "Der Soldatenmord von Lebach". In diesem bedeutenden Kriminalfall aus dem Jahre 1969 hatten zwei M nner bei einem berfall auf ein Waffen- und Munitionsdepot der Bundeswehr drei Soldaten im Schlaf ermordet und einen vierten schwer verletzt. Der Fall erregte die ffentlichkeit in hohem Ma e, da die Diskussionen um das Bestehen einer Armee in Deutschland noch nicht verstummt waren. Aufgrund des hohen Publikumsinteresses beauftragte der ZDF Programmdirektor Joseph Vieh ver J rgen Neven-du Mont mit der Produktion eines Dokumentarspiels. Im Fr hjahr 1972 wurde der Film fertiggestellt und sollte im Juni des selben Jahres ausgestrahlt werden. Der T ter hatte eine Unterlassungsklage beim Landgericht Mainz eingereicht. Er begr ndete die Klage mit einer Erschwerung seiner Resozialisierung, da er bald entlassen werden sollte. Im Juni lehnte das Landgericht Mainz die Klage mit der Begr ndung ab. Der Kl ger ging jedoch in Revision vor das Oberlandesgericht, welches die Klage ebenfalls ablehnte. Die Ausstrahlung wurde dennoch verschoben, da auch seitens der Politik und Medien Kritik am Format der Sendung ge bt wurde. Der Kl ger begr ndete seine anschlie ende Klage vor dem Bundesverfassungsgericht mit dem Argument, dass falls es zu einer Ausstrahlung komme, dies eine erhebliche Verletzung seiner Privatsph re bedeuten w rde. Am 5. Juni 1973 untersagte das Bundesverfassungsgericht dem Sender die Ausstrahlung. In seinem Urteil stellte es fest, dass die in Art. 5 Abs. 1 Satz 2 GG garantierte Rundfunkfreiheit eingeschr nkt werden kann, wenn diese in Konflikt mit anderen Rechtsg tern ger t. Unter Androhung einer Geldbu e untersagte das Gericht dem ZDF den Kl ger namentlich zu erw hnen oder darzustellen. In der Folgezeit entbrannte ein Rechtsstreit, der wiederum bis vor das Verfas
