Inzest - kaum ein anderes Phänomen scheint so universell und allgegenwärtig zu sein. Die Arbeit leistet einen Beitrag zur Aufklärung des Mysteriums Inzest und letztlich zu dessen Entkriminalisierung. Nach einem Überblick über die Entstehungsgeschichte der Strafbarkeit wird die aktuelle Rechtslage näher beleuchtet. Im Mittelpunkt steht dabei die ausführliche Analyse der Rechtsgüter, deren Schutz 173 StGB angeblich dienen soll und hieran anknüpfend die Untersuchung, ob das gefundene Ergebnis den Anforderungen strafrechtlicher Legitimation genügt. Darüber hinaus erfolgt die Überprüfung der Verfassungsmä igkeit der Norm unter Einschlu eines jüngst hierzu ergangenen Urteils des Bundesverfassungsgerichts.

Die Autorin: Sandra Karst, geboren 1979 in Ostfildern, studierte Rechtswissenschaften an der Universität Tübingen und absolvierte ihr Referendariat in Stuttgart. Nach dem Zweiten juristischen Staatsexamen begann sie im Herbst 2006 mit ihrer Dissertation an der Universität Konstanz. Seit Frühjahr 2007 ist sie in der Innenverwaltung des Landes Baden-Württemberg tätig.
