Die vollmachtlose Prozessvertretung ist bereits seit Geltung der Zivilprozessordnung Gegenstand juristischer Kontroversen. Dennoch sind viele Fragen offen geblieben. So ist bisher nicht geklärt, warum die Klage eines vollmachtlosen Vertreters überhaupt bei Gericht Beachtung findet und zu einem Rechtsstreit führen kann. Unklar ist auch, inwieweit die fehlende Vollmacht einer Rücknahme der Klage entgegensteht. Hinsichtlich der kostenrechtlichen Folgen der vollmachtlosen Prozessvertretung hat sich zwar in der Lehre und Rechtsprechung die Kostenentscheidung nach dem Veranlassungsprinzip durchgesetzt, die Untersuchung der rechtlichen Herleitung und die Ausgestaltung dieses Haftungsprinzips offenbaren jedoch, dass auch die Kostenfrage noch nicht abschlie end beantwortet worden ist. Der Autor zeigt mit dieser Arbeit Lösungswege auf, welche für die verschiedenen Fallgestaltungen der vollmachtlosen Prozessvertretung eine rechtliche Beurteilung eng an den Vorschriften der Zivilprozessordnung, insbesondere auf der Grundlage des 89 ZPO, ermöglichen.

About The Author

Der Autor: Diethard Breitkopf wurde 1970 in Beirut geboren. Er studierte Rechtswissenschaften an den Universitäten Osnabrück, Freiburg im Breisgau sowie Göttingen und legte 1996 die Erste juristische Staatsprüfung ab. Es folgte das Referendariat im Bezirk des Oberlandesgerichts Hamm, das er 1999 mit der Zweiten juristischen Staatsprüfung abschloss. Seit 1999 ist der Autor Rechtsanwalt in Osnabrück. 2003 promovierte er zum Doktor der Rechte.
