Besonders die ersten Entscheidungen helfen dem Verfassungsgericht sich selbst zu finden und seine Aufgabe in der neuen Demokratie zu bestimmen. Das Ziel der folgenden Arbeit soll die Darstellung der Bedeutung eines Verfassungsgerichts für eine sich entwickelnde Demokratie sein. Vor diesem Hintergrund findet eine Analyse der Aufgaben postsowjetischer, aber insbesondere des ukrainischen Verfassungsgerichts statt. Hierbei wird die anfängliche Rechtsprechung ausgewertet. Es soll bewertet werden inwieweit sich das ukrainische Verfassungsgericht in die Demokratie einbindet und mit seinen Entscheidungen zur weiteren Demokratisierung des Landes beiträgt. Des Weiteren soll anhand der Entscheidungen analysiert werden, in welchem Umfang das ukrainische Verfassungsgericht mit den ihm durch die Verfassung auferlegten Aufgaben zurechtkommt und inwieweit diese von ihm erfüllt werden.

Leonid Shmatenko ist seit 2017 Rechtsanwalt bei LALIVE und Mitglied im International Arbitration Team. Er ist auf die Bereiche internationale Handelsschiedsgerichtsbarkeit und Investor-Staat Schiedsgerichtsbarkeit spezialisiert und war als Parteivertreter sowie Sekretär des Schiedsgerichts in über 20 internationalen Schiedsverfahren in Deutsch, Englisch und Französisch tätig. Leonid Shmatenko ist Student Fellow des Chartered Institute of Arbitrators und Mitglied diverser internationaler schiedsrechtlicher Vereinigungen, u.a. des Young International Council for Commercial Arbitration (Young ICCA), der Deutschen Institution für Schiedsgerichtsbarkeit (DIS) und der DIS40, der LCIA Young International Arbitration Group (YIAG) sowie der ASA Below 40. Vor seiner Tätigkeit bei LALIVE war Leonid Shmatenko als Rechtsanwalt in der Kanzlei Kantenwein Zimmermann Fox Kröck & Partner in München und als Foreign Attorney bei Orrick Herrington Sutcliffe LLP in Paris tätig. Sein Referendariat absolvierte er u.a. bei Derains & Gharavi in Paris und Freshfields Bruckhaus Deringer LLP in Düsseldorf. Zuvor war er Praktikant bei Freshfields Bruckhaus Deringer LLP in Paris sowie Clayton Utz in Sydney, wo er vornehmlich in den Bereichen der nationalen und internationalen Schiedsgerichtsbarkeit tätig war. Zwischen 2011 und 2013 war er wissenschaftlicher Mitarbeiter an der Heinrich-Heine-Universität Düsseldorf und unterrichtete dort Verwaltungsrecht und Investitionsschutzrecht. Leonid Shmatenko studierte Rechtswissenschaften an der Heinrich-Heine-Universität Düsseldorf zwischen 2006 und 2011. Sein erstes juristisches Staatsexamen (Dipl. jur.) legte er in 2011 und sein zweites juristisches Staatsexamen in 2015 in Düsseldorf ab. Herr Shmatenko hat seine Dissertation an der Heinrich-Heine-Universität Düsseldorf zu einem investitionsschutzrechtlichen Thema fertiggestellt und erwartet seine Ernennung zum Doktor. Gegenwärtig ist er Lehrbeauftrager für Investitionsschiedsgerichtsbarkeit an der Nationalen Technischen Universität "Kiewer Polytechnisches Institut Ihor Sikorskyj".
