Die digitale und die grüne Transformation zählen zu den zentralen Triebkräften tiefgreifender gesellschaftlicher Veränderungen. Als sogenannte "Twin Transition" prägt sie wirtschaftliche Prozesse, staatliches Handeln und individuelle Lebensrealitäten gleichermaßen. Dem (öffentlichen) Recht kommt dabei eine wichtige Steuerungsaufgabe zu, um die Transformationsprozesse legitim, gerecht und dauerhaft tragfähig zu gestalten.
Dieser Sammelband widmet sich zum einen der Untersuchung der Zusammenhänge und Wechselwirkungen zwischen diesen beiden Transformationen aus einer rechtswissenschaftlichen Perspektive und stellt dabei die Frage, welche Rolle das Recht in diesem Kontext spielt und wie es die digitale und grüne Transformation nicht nur begleiten, sondern auch aktiv gestalten kann und muss.
Dabei wird die Rolle des Verhältnismäßigkeitsgrundsatzes und der Gleichheitsrechte im Kontext des grünen und digitalen Wandels ebenso behandelt, wie die Bedeutung von (ESG-)Daten, Data-Governance, Sustainable Finance oder dem Raumplanungsrecht. Die Analyse insbesondere auch des europäischen Rechtsrahmens fördern sowohl dessen Möglichkeiten als auch Schwachstellen und Reformbedarf de lege ferenda zu Tage.

About The Author

Claudia Wutscher studierte Rechtswissenschaften und Philosophie an der Universität Wien und an der Wirtschaftsuniversität Wien. Sie hat eine venia docendi für Öffentliches Recht und Europarecht und ist derzeit assoziierte Professorin am Institut für Österreichisches und Europäisches Öffentliches Recht der WU Wien sowie Director des WU Legal Tech Centers. Zu ihren Forschungsschwerpunkten zählen Klima-, Umwelt- und Nachhaltigkeitsrecht, Legal Tech und Rechtsfragen der Digitalisierung, Recht der Wirtschafts- und Währungsunion, Banken- und Finanzmarktrecht, Binnenmarktrecht, Grund- und Menschenrechte, Haushaltsrecht sowie Rechtstheorie.

Sophie Martinetz ist Director des WU Legal Tech Centers. Sie kennt die Bedürfnisse, Chancen, Risiken und zukünftigen Herausforderungen der Rechtsbranche wie keine andere. Dafür wurde sie 2021 von Brutkasten als Innovatorin des Jahres nominiert, 2020 als Women of Legal Tech geehrt und im selben Jahr mit dem European Tech Women Award ausgezeichnet. Nach einer internationalen Karriere in Berlin und London kehrte die gelernte Juristin mit 15 Jahren Erfahrung im internationalen Management und Expertise in der Digitalisierung zurück nach Wien und gründete 2017 Future-Law.
