Das Handelsrecht als Recht des Kaufmanns gehört zu den ältesten rechtlichen Ord- nungen für den Wirtschafts- und Handelsverkehr. Es ist daher auch in besonderem Ma e durch Handelsbräuche und z. T. Jahrhunderte alte Gepflogenheiten mit geprägt und gestaltet worden. Neue Organisations- und Informationsmittel gewinnen Einflu auf die handelsrechtliche Ordnung; der Begriffsinhalt der guten Sitten im Wettbe- werbsrecht erhält durch nationale und supranationale Kartellrechtsbestimmungen, etwa der Art. 85, 86 EG-Vertrag, neue Färbungen. Das am 1. 4.1977 in Kraft getretene Gesetz zur Regelung des Rechts der allgemeinen Geschäftsbedingungen nimmt Einflu auf die typisierte Vertragsgestaltung im wirtschaftsrechtlichen Be- reich. Dennoch können diese Besonderheiten eines Rechtsgebietes nur verstanden und sinnvoll angewandt werden, wenn deren allgemeine Rechtsquellen bewu t sind. Das geltende Handelsrecht ist ohne die meist im Schuldrecht des BGB anknüpfenden Rechtsgrundlagen nicht verständlich. Darüberhinaus müssen, etwa im Zusammen- hang mit den Vertragsverhältnissen der Handlungsgehilfen, die angrenzenden Rechtsbereiche des Arbeitsrechts angesprochen werden. Insoweit durchdringen so- zialrechtliche Grundsätze auch den Bereich des Handelsrechtes, soweit die Tätigkeit eine persönliche Abhängigkeit, also etwa das Anstellungsverhältnis eines Handlungs- gehilfen, in Rede steht. Ergänzt werden diese Ausführungen durch den Titel: Gesell- scbaftsrecht, der die handelsrechtlichen Problemkreise im gesellschaftlichen Rah- men weiterführt. Kein Rechtsgebiet ist freilich isoliert zu sehen. So sind bei typisierten -Vertrags- gestaltungen die Grundsätze des UWG ebenso zu beachten, wie seit dem 1. 4. 1977 das Gesetz zur Regelung des Rechts der allgemeinen Geschäftsbedingungen. Gelingt einem Handlungsgehilfen eine schutzwürdige Erfindung, ist darüberhinaus das Arbeitnehmererfindungsgesetz zu beachten.
