Am Ende des 19. bzw. Beginn des 20. Jahrhunderts existierte im deutschen Schutzgebiet Südwestafrika (1884-1919) lediglich eine staatliche Gouvernements-/Militärverwaltung, die auch kommunale Belange zu regeln hatte. Die Arbeit beschäftigt sich mit der politischen Beteiligung der wei en Siedler des ehemaligen Südwestafrikas und deren rechtlicher Ausgestaltung. Die einzelnen Schritte hin zu einer kolonialen Selbstverwaltung werden herausgearbeitet. Nachgegangen wird dabei der Frage, ob wei e Siedler schon allein wegen ihrer Herkunft und ihrer Rolle als Wahrer europäischer Landnahme auch Nutznie er in rechtlicher Hinsicht waren oder ob ihr rechtlicher Status mit demjenigen im Deutschen Reich nicht vergleichbar war, weil beispielsweise die Reichsverfassung und das BGB überhaupt nicht oder nur teilweise in den damaligen deutschen Schutzgebieten galten. Deutsche Siedler hatten sich mit dem Überwechseln nach Afrika scheinbar sämtlicher politischer Mitbestimmungsrechte, die sie im Mutterland besessen hatten, entäu ert. Mit Hilfe der Auswertung umfangreichen Aktenmaterials in Deutschland und Übersee sowie der Heranziehung einschlägiger kolonialrechtlicher Bestimmungen (im Anhang abgedruckt) wird der rechtlich-politische Emanzipationsproze der wei en Siedler gegenüber der eigenen Kolonialverwaltung nachgezeichnet. Behandelt wird dabei das ursprünglich bestehende Verwaltungs- und Rechtssystem bis hin zur gesetzlichen Einräumung kolonialer Selbstverwaltung . Die vor allem im Nationalarchiv von Namibia festgehaltenen tatsächlichen Umsetzungsschwierigkeiten des Kolonialrechts finden dabei breite Berücksichtigung.

Der Autor: Hansjörg Michael Huber, geboren 1960 in Köln, studierte ab 1979 Rechtswissenschaften und Geschichte in München. Erstes Juristisches Staatsexamen 1985, Zweites Juristisches Staatsexamen und Magisterprüfung Geschichte 1988/89. Von 1989 bis Ende 1992 Mitglied des Graduiertenkollegs Rechtsgeschichte an der Universität Frankfurt/Main. Seit 1993 Professor für Staats- und Verwaltungsrecht an der Hochschule Zittau/Görlitz.
