Ist dem Arbeitgeber bei Ausspruch der Kündigung die Schwerbehinderung des Arbeitnehmers bzw. dessen Gleichstellung nicht bekannt und hatte der Arbeitgeber die Zustimmung des Integrationsamts folglich auch nicht beantragt, so muss sich der Arbeitnehmer - zur Erhaltung seines Sonderkündigungsschutzes nach 85 SGB IX - innerhalb von drei Wochen nach Zugang der Kündigung auf diesen Sonderkündigungsschutz berufen. Der besondere Kündigungsschutz der 85 ff SGB IX gilt für alle Arten von Kündigungen (Beendigungs-, Änderungskündigung, Kündigung im Insolvenzverfahren etc.) durch den Arbeitgeber.
