Die Auseinandersetzung hinsichtlich der Abgrenzung von negatorischer Beseitigung und Schadensersatz wird durch zwei unterschiedliche Extrempositionen geprägt. Zum einen fasst die Rechtsusurpationslehre den Anwendungsbereich von 1004 I 1 BGB sehr eng, wohingegen die herrschende Meinung in Schrifttum und Rechtsprechung unter einer Eigentumsbeeinträchtigung jeden dem 903 BGB widersprechenden tatsächlichen Zustand versteht. Die Auseinandersetzung beider Positionen leidet allerdings daran, dass die Ursache für die Überschneidung beider Vorschriften nicht deutlich herausgearbeitet wird und der Streit um die richtige Abgrenzung der Ansprüche vor allem mit Plausibilitätsargumenten und wenig auf dogmatischer Ebene geführt wird. Der Autor geht in diesem Buch genau den umgekehrten Weg. Er erörtert zunächst die dogmatischen Grundlagen und deckt so den Grund für die Überschneidung von 1004 I 1 BGB mit den 823 I, 249 ff. BGB auf. Dabei wird nicht nur der aktuelle Streitstand ausführlich aufgearbeitet, sondern ein in sich abgeschlossenes und überzeugendes Konzept für die Abgrenzungsproblematik dargelegt und so die erforderliche Rechtssicherheit geschaffen, welche insbesondere die Anhänger der Rechtsusurpationslehre immer vermisst haben.

Der Autor: Marc Wolf wurde 1972 in Bad Arolsen geboren. Er studierte von 1992 bis 1997 Rechtswissenschaften an der Universität Göttingen. Nach dem Referendariat am Landgericht Kassel war er Wissenschaftlicher Mitarbeiter am Institut für Handels- und Wirtschaftsrecht an der Universität Marburg. Seit 2005 ist er im Justizdienst des Landes Hessen tätig.
