Die Zwangsvollstreckung ist das staatlich geregelte Verfahren zur Durch- setzung und Sicherung von vornehmlich privatrechtlichen Ansprüchen mittels staatlichen Zwangs. Zahlt der Käufer nicht freiwillig den vereinbarten Kaufpreis, gibt der Besitzer dem Eigentümer die grundlos vorenthaltene Sache nicht heraus, weigert sich der Erbe, dem Pflichtteilsberechtigten über den Bestand des Nachlasses Auskunft zu erteilen, so mu es Mittel und Wege geben, die Rechte des Verkäufers, des Eigentümers und des Pflichtteilsberechtigten auch gegen den Willen des Käufers, des Besitzers und des Erben durchzu- setzen. Den erforderlichen Zwang im Wege der Selbsthilfe auszuüben, kann die Rechtsordnung dem Berechtigten nicht gestatten. Dem Schwachen würde die Erlaubnis ohnehin nichts nützen, der Starke käme in Versuchung, sich Übergriffe zu erlauben. Eine solche Art von Selbsthilfe gefährdet den Rechts- frieden innerhalb der Gemeinschaft. Selbsthilfe ist deshalb heute nur noch in seltenen Ausnahmefällen erlaubt. 2. Der Staat mu aber die Durchsetzbarkeit seiner Privatrechtsordnung gewährleisten. Verbietet er dem einzelnen, im Wege der Selbsthilfe sein vermeintliches Recht zu suchen, so übernimmt er seinerseits die Pflicht, l Re c h t s s hut c z zu gewähren). Bei der Zwangsvollstreckung handelt es sich darum, auf Verlan- gen des Berechtigten die staatlichen Zwangsmittel einzusetzen, um den Ver- pflichteten zu zwingen, die Privatrechtsordnung zu beachten.
