Die bedeutendste Vorarbeit zur Geschichte der Strafe haben bei uns Germanisten, HEINRICH BRUNNER, OTTO VON GIERKE, KARL VON AMIRA, HANS FEHR und RUDOLF HIS geleistet. Ihr Interesse galt den Rechtsbildungen der nordischen Kultur, und sie haben aus allen Ecken und Enden Tatsachen herbeigetragen und Beziehungen auf- gedeckt. Der Gedanke lag nahe, die Grundlage zu erweitern, religions- geschichtliches, ethnologisches, klassisches und volkskundliches Material heranzuholen und andere Kulturkreise an der Aufhellung der Probleme teilnehmen zu lassen. Diese Aufgabe habe ich mir gestellt und dabei die Pflicht gedrang- tester Darstellung auferlegt. Zwanzig Jahre unausgesetzten Studiums haben aus dem einen Band der alten "Strafe" (Stuttgart 1932), der schon langst nicht mehr zu haben ist, ein ganz neues Werk gemacht. Es wird in zwei Banden: "Friihformen und kulturgeschichtliche Zu- sammenhange" und "Moderne Erscheinungsformen der Strafe" er- scheinen. Diese Arbeit und der zweite Band miissen in vielen Stiicken dem Religionsforscher, dem Soziologen und dem Ethnologen weniger fremd erscheinen als dem Juristen, wenn sie auch fUr sie aIle bestimmt sind. Die "moderne" Strafe gehort der Psychologie und der Gesellschaftswissen- schaft an. Ihre Wurzeln aber reichen tief in Entwicklungsstufen hinab, die vor der festen Rechtsordnung und dem jetzigen Begriff der Zweck- maBigkeit liegen. In diesem Halbdunkel konnen wir uns nur der Fiih- rung von Kulturgeschichte und Volkerkunde iiberlassen. Auch sie ver- mogen freilich nicht aIle Fragen zu beantworten und sie fragen in Gestalt von Hypothesen und umstrittenen Deutungsversuchen zuriick.
