Alterspadophilie gesagt, sie sei "Krimina- litat aus Schwache"; vielleicht laBt sich vereinfachend diese Formel aufKriminaliilit liberhaupt libertragen: ein Randeln aus Schwache, Ausdruck eines Scheitems, Zeichen von Ausweglosigkeit, ein Agie- ren angesichts nicht nur unlosbarer, oft auch gar nicht benennbarer Konflikte. Dies ist auch nicht anders, wenn es urn "die Morder" geht. So konnen sie getrost auch Gegenstand von wissenschaftlichen Unter- suchungen werden. Sie rlicken damit in unsere Nahe, es ergeben sich Verstandlichkeiten; dies eroffnet Zugang und Moglichkeiten eines rationalen und vielleicht auch hilfreichen Umgehens mit ihnen. Die Maxime des angemessenen, rationalen, humanen U mgangs mit dem Straftater setzt ein hohes MaB an Aufklarung voraus. Der "moralische Reflex" des Abwertens und der Vergeltung muB liber- wunden werden. Dies ram besonders schwer bei Totungsdelikten. Offenkundig ist dies schon deshalb, wei! trotz aller Versachlichungs- bestrebungen in der Rechtsprechung an der moralisch wertenden Unterteilung von Totungshandlungen festgehalten wird: Von dem Begriff der "Unzucht" hat man sich bei der letzten Strafrechtsreform getrennt und ihn durch den neutraleren Begriff der "Handlung gegen die sexuelle Selbstbestimmung" ersetzt; von dem Begriff des "Mor- des" in Abgrenzung zum "Totschlag" hat man nicht lassen konnen, obwohl dies rational im Sinne von Aufkiarung nicht begrlindbar ist.
