Der sachgerechte und ordnungsgemiiBe Umgang mit wassergefiihrdenden Stoffen in Gewerbe- und Industriebetrieben, aber auch in Haushaltungen, ist eine der wichtig- sten Aufgaben des aktiven Umweltschutzes. Dem Wasser kommt dabei eine wesent- liche Schliisselposition auf dem langen Weg der Produktentstehung iiber Nutzung und Anwendung bis zur Beseitigung zu, da grundsiitzlich jeder wassergefiihrdende Stoffbzw. jedes Produkt letztlich in den Wasserkreislauf gelangen kann. Die Vielzahl und das AusmaB der 01- und Giftunfiille belegt mit Nachdruck, daB das "Vorsorgeprinzip" als Grundsatz eines wirkungsvollen Gewiisserschutzes noch mehr in den Vordergrund geriickt werden muB. Uber das Wasserrecht hinaus trag en viele andere Gesetze durch Aufnahme umweltrelevanter Regelungen, wie z. B. das Abfall- beseitigungsgesetz, Altolgesetz, Bundesimmissionsschutzgesetz, Waschmittelgesetz, zum Gewiisserschutz bei. Mit der 4. Novelle zum Wasserhaushaltsgesetz im Jahre 1976 hat der Bundesgesetz- geber in den 19 g-k das Lagern, Abfiillen und Umschlagen von wassergefiihrden- den Stoffen und in dem 191 die Zulassung von Fachbetrieben speziell geregelt. Die fiir dies en Bereich aufgenommene allgemeine SorgfaltspfIicht liiBt sich an fol- genden Schwerpunkten festschreiben: - Anlagen zum Lagern und Abfiillen miissen so beschaffen und so eingebaut, auf- gestellt, unterhalten und betrieben werden, daB eine Verunreinigung der Gewiisser oder eine sonstige nachteilige Veriinderung ihrer Eigenschaften nicht zu besorgen ist ( 19 gAbs. 1 WHG). - Anlagen zum Umschlagen miissen so beschaffen sein und so eingebaut, aufge- stellt, unterhalten und betrieben werden, daB der bestmogliche Schutz der Gewiisser vor Verunreinigungen oder sonstiger nachteiliger Veriinderung ihrer Eigenschaft erreicht wird ( 19 gAbs. 2 WHG).
