Aus wissenschaftlicher Sicht problematisch ist dabei die in öffentlicher Meinung ebenso wie auch in der Verfassung (Deutschland) herrschende Auffassung von der Gleichsetzung der beiden Institutionen Ehe und Familie; sind doch beides gänzlich unterschiedliche Beziehungsformen. Der Begriff der Familie ist erst während der Renaissance entstanden und im Rahmen der Verrechtlichung des bürgerlichen Lebens in den wachsenden städtischen Kommunen zur zentralen Grundeinheit geworden. Zuvor sprach man nur von wirtschaftlichen Gemeinschaften und ausgehend von der bäuerlichen Agrarwirtschaft von der Institution des ganzen Hauses. Diese Institution umfa te nicht nur die klassische Mehrgenerationen-Kernfamilie, sondern zB auch Mägde und Knechte oder im Handwerksbereich etwa Lehrlinge. Erst im 19. Jht. setzte sich ein Verständnis von Familie durch, das sich an der rechtlichen Institution der Ehe und der Liebesheirat orientierte.
