Konflikte waren immer schon ein Teil unseres gesellschaftlichen Lebens und müssen es auch offenbar sein. Die rasanten Veränderungen der letzten Jahre in unserer Gesellschaft haben die Konfliktbereitschaft in der Bevölkerung zusätzlich gefördert. So engt z.B. eine Flut von Gesetzen und Verordnungen unsere persönlichen Handlungsspielräume ein und nimmt dadurch auch wesentlichen Einfluss auf unsere Lebensabläufe. Die Bürger sind immer weniger bereit, diese Einwirkung auf ihre Interessen kritiklos hinzunehmen. Die zunehmende Bereitschaft, die Austragung von Rechtsstreitigkeiten auch finanziell abzusichern - z.B. durch den Abschluss privater Rechtsschutz-versicherungen - trägt dieser gesteigerten Konfliktbereitschaft Rechnung. Zugleich ist zu beobachten, dass immer mehr Agenden des persönlichen Bereiches an Fachleute delegiert werden, so auch die Konflikte. Wenn sich nun die Fronten zwischen den Konfliktpartnern verhärten und erstarren, werden au enstehende Dritte angerufen, um zu helfen. Sehr oft wird dann in dieser scheinbar ausweglosen Situation auf unser Rechtssystem zurückgegriffen, und so enden viele dieser Konflikte vor Gericht. Ob Schuldspruch oder Vergleich, gerichtliche Entscheidungen führen in den seltensten Fällen zur Befriedung der Situation - ganz im Gegenteil - meist führen sie sogar direkt in eine Eskalation. Das Interesse am Fortbestand der Beziehungsebene zwischen den Streitparteien ist dann zerstört und ein weiteres gesellschaftliches Zusammenleben wird sehr schwierig. Gerichtsentscheidungen sind Streitentscheidungen, die den Konflikt nicht wirklich beenden. Sie fragen sich nun: "Gibt es überhaupt Wege, Streitigkeiten anders zu regeln?" Die Antwort lautet: "Ja! Es gibt Wege, Strategien und Möglichkeiten nämlich mit Mediation!"
