Das Problem der neutralen Beihilfe ist vielmehr eine der meistdiskutierten Fragen der letzten Zeit in der strafrechtlichen Literatur. Ziel der Untersuchung ist es, den aktuellen Stand der Diskussion zu ergründen, indem die zur Lösung der Problematik in Rechtsprechung und Literatur entwickelten Meinungen umfassend dargestellt werden. Am Ende wird auch ein Ausblick gegeben, inwieweit sich die Diskussion entwickeln könnte oder sollte. Neben allgemeinen Erwägungen zum Begriff der "berufstypischen Handlung" und grundsätzlichen strafrechtsdogmatischn Grundlagen, wird zunächst in einem kurzen Überblick die Strafbarkeit der "normalen" Beihilfe beleuchtet. Es werden die verschiedenen Formen von neutralen, berufstypischen Handlungen in Fallgruppen unterteilt, zum einen für einen besseren Überblick über die Vielgestaltigkeit der Handlungen, zum anderen weil an die Strafbarkeit beziehungsweise die Voraussetzungen einer Einschränkung derselben (teilweise) besondere Anforderungen gelten können. Anschlie end werden die in der Literatur vertretenen Ansichten zur Lösung der Problematik umfassend untersucht und die an den jeweiligen Ansichten geäu erte Kritik dargestellt. In Kapitel G wird die Kasuistik der Judikatur zur Thematik der berufstypischen Handlungen untersucht, ausgehend von einigen historischen Entscheidungen des Reichsgerichts sowie einigen älteren Entscheidungen des BGH. Danach geht es in einem eigenen Abschnitt um eine beachtliche Entwicklung der Rechtsprechung in den vergangenen 20 Jahren, ausgehend von einigen wichtigen Entscheidungen um das Jahr 2000 herum. Abschlie end werden auch einige jüngst ergangene Entscheidungen des BGH untersucht. Ein gesondertes Kapitel widmet diese Arbeit der berufstypischen Handlung durch die
