Die Untersuchung betrieblicher Kindertagesstatten und betrieblicher So- zialeinrichtungen liiBt sich unter verschiedenen Gesichtspunkten vornehmen. So ist es bei diesen Themen z.B. naheliegend, sie aus erziehungswissen- schaftlicher, sozialpsychologischer oder sozial6konomischer Sicht zu analy- sieren. Die folgende Untersuchung ist in ihrem Ausgangspunkt eine juristi- sche Untersuchung, die als Grundlage das Normengeflecht der betrieblichen Sozialeinrichtungen und die damit verbundenen Zwecke untersucht. Die Ar- beit verharrt jedoch nicht an diesem Punkt, sondern wendet sich in einem zweiten Schritt klassischen rechtssoziologischen Fragen zu, die sich auf die Umsetzung und den Alltag dieser Normen beziehen. Insoweit wird themati- siert, welche Folgen die Transformation der gesamten Rechts- und Sozial- ordnung in Ostdeutschland fUr den Status und die weitere Existenz dieser Sozialeinrichtungen hatte. Fur diesen Aspekt der Untersuchung boten sich klassische Formen der 1 rechtssoziologischen Arbeitsweise an, namlich die DurchfUhrung von Be- triebsstudien mit Hilfe von Aktenanalysen und Interviews. Beide Methoden k6nnen jedoch bei Untersuchungen zur sozialen Transformation nur mit gro- Ber Vorsicht angewandt werden. Hinsichtlich der Aktenanalysen besteht grundsatzlich kein Mangel an Akten; zumindest ein Teil der privatisierten Unternehmen unterhielt 1994/95 noch ein Betriebsarchiv. Andere Unterneh- men haben ihre Unterlagen an die Landesarchive abgegeben, wo sie bisher allerdings nur zu einem geringen Teil fUr die Offentlichkeit erschlcissen sind.
