Inwieweit das sogenannte Churning (Spesenschinderei) ein deliktisches Verhalten darstellt, unterzieht die Verfasserin einer eingehenden Würdigung. Dargestellt wird zunächst der Begriff der Spesenschinderei. Es folgt eine kritische Betrachtung der Strafbarkeit dieser Verhaltensweise wegen Betrugs gemä 263 Abs. 1 StGB, Untreue nach 266 Abs. 1 1. und 2. Alt. StGB sowie wegen Verleitung zu Börsenspekulationsgeschäften, 49, 26 BörsG.

About The Author

Die Autorin: Nina Nestler, 1982 geboren, studierte Rechtswissenschaften in Würzburg, wo sie 2005 das Erste juristische Staatsexamen ablegte. Danach absolvierte sie das Referendariat im Oberlandesgerichtsbezirk Bamberg mit dem Abschluss durch die Zweite juristische Staatsprüfung. Ab dem Jahr 2003 war die Autorin Studentische bzw. Wissenschaftliche Mitarbeiterin am Lehrstuhl für Kriminologie und Strafrecht der Universität Würzburg. Seit 2008 ist sie dort Wissenschaftliche Assistentin.
