Esta es la tercera edición del Código de Derecho Internacional del profesor Asdrúbal Aguiar, texto de enseñanza universitaria cuyas primera y segunda ediciones corresponden a los años 2006 y 2009, llega en un momento en el que cristalizan otras realidades a nivel global. Es otro el contexto dentro del que comienzan a fluir las relaciones jurídicas internacionales contemporáneas.

A partir de 1989 y en el curso de los treinta años que concluyen el pasado 2019, se ha desarrollado una verdadera disrupción histórica o ruptura epistemológica a nivel global. Metafóricamente explicada le pone fin o término al ejercicio del poder político centralizado sobre los espacios jurisdiccionales de los Estados y de la misma comunidad internacional que estos forman. Es la consecuencia del ingreso de la Humanidad a la tercera revolución industrial, la digital, y desde el momento en que ocurre la pandemia universal de 2020 y 2021, de la aceleración de la cuarta revolución industrial, la de la inteligencia artificial. Una y otra han roto la relación del tiempo con el espacio geopolítico, e intentan hacer del cosmos y sus cosmovisiones tiempos sin espacio, también sin referencias de tiempo por la virtualidad e instantaneidad que les caracteriza.

Cuánto de lo dado y lo enseñado hasta hoy por quienes somos profesores de Derecho internacional quedará en pie? No lo sabemos aún. La historia solapa sus tiempos, no los corta en seco. Eso sí, resulta obligante considerar lo evidente y antes señalado para que el estudio de dicha disciplina no se vuelva oficio de antropólogos. Por lo pronto, apenas podemos alertar e invitar a que se debatan tales innovaciones sin complejos, libres de ataduras dogmáticas, sea por los profesores como por sus estudiantes y, en general, por los estudiosos del Derecho y las relaciones internacionales.
