El 25 de abril de 1974 el Movimiento de las Fuerzas Armadas (o Movimento das Forças Armadas) derribó el régimen fascista, coronando la larga resistencia del pueblo portugués e interpretando sus sentimiento profundos. Conocida con el nombre de Revolución de los claveles porque la población inundó las calles de Lisboa con claveles rojos que colocó en la boca de los fusiles del ejército, Portugal ponía punto final a sus 46 años de dictadura impuesta por el economista portugués, Antonio de Oliveira Salazar.

Liberar a Portugal de la dictadura, la opresión y el colonialismo representó el comienzo de una inflexión histórica de la sociedad portuguesa. La Revolución devolvió a los portugueses los derechos y libertades fundamentales. En ejercicio de estos derechos y libertades se reunieron los legítimos representantes del pueblo para elaborar una Constitución que correspondiese a las aspiraciones del país.

La Constitución portuguesa de 1976, aprobada como consecuencia de la Revolución democrática de 25 de abril de 1974, inspirada en ideales democráticos y socializantes, presenta en el ámbito económico-social un conjunto importante de disposiciones programáticas y preceptivas orientadas a la realización de una economía de bienestar y de justicia social, en el ámbito de un Estado social de Derecho.

La Constitución portuguesa de 1976 es la actual constitución de la República Portuguesa. Fue adoptada por la Asamblea Constituyente el 2 de abril de 1976 y entró en vigor el 25 de abril de 1976, aniversario de la Revolución de los Claveles. Está compuesta por 311 artículos y ha sido modificada en 7 ocasiones desde su entrada en vigor.
