La Constitución del Estado Libre Asociado de Puerto Rico fue adoptada el 6 de febrero de 1952. El texto fue ratificado por el electorado de Puerto Rico en un referéndum el 3 de marzo de 1952. El Congreso de los Estados Unidos lo aprobó, y fue promulgado el 3 de julio de 1952.

El texto de la Constitución está integrado por un Preámbulo y los siguientes nueve artículos (cada uno de ellos compuesto por varias Secciones):


I) Del Estado Libre Asociado;

II) Carta de derechos;

III) Del Poder Legislativo;

IV) Del Poder Ejecutivo;

V) Del Poder Judicial;

VI) Disposiciones generales;

VII) De las enmiendas a la Constitución;

VIII) De los Distritos senatoriales y de los representativos;

IX) Disposiciones transitorias.

La Constitución de Puerto Rico recoge una estructura gubernamental interna muy parecida a la de un estado de la nación norteamericana. Durante el proceso de elaboración de la Constitución nunca fue puesta en discusión la pertenencia de la isla a los Estados Unidos ni el mantenimiento de tal dominio. Por esta razón muchas voces críticas equiparan la Constitución a una carta colonial.

Puerto Rico es un Estado Libre Asociado pero creado dentro de la unión con los Estados Unidos de América (véase el Preámbulo).

Los Estados Unidos autorizaron el ejercicio de una suerte de autonomía isleña sin reconocer a Puerto Rico derechos plenos de ciudadanía (voto presidencial, representación en el Congreso). Para todos los efectos prácticos, Puerto Rico sigue


perteneciendo a los Estados Unidos sin formar parte de dicha nación


tal como lo declaró el Tribunal Supremo de los Estados Unidos hace más de un siglo.
