La Constitución Federal española de 1873 fue un proyecto de constitución para la Primera República Española, redactado principalmente por Emilio Castelar. No llegó a ser aprobado por las Cortes. Pretendía la transformación de España en una federación.

Estaba muy influida por la Constitución de los Estados Unidos en los términos (Estados federados, Constituciones estatales y Tribunal Supremo federal...). También en la organización de las instituciones (Senado electo por los parlamentos de los Estados y con igual representación independientemente del tamaño y población).

La Constitución Federal española de 1873 contemplaba la elección del presidente de la República mediante un colegio electoral. Un Tribunal Supremo federal se ocuparía del control de la constitucionalidad de las leyes y dirimiría los conflictos entre los Estados y el poder federal.

Defendía la prevalencia del derecho federal sobre el de los Estados y el reparto de las competencias entre la Federación y estos. Estuvo, además, influida por la Constitución española de 1869. De ella tomó la declaración de derechos. Planteó, además, la separación entre la Iglesia y el Estado, la abolición de los títulos de nobleza y el reconocimiento de la libertad de cultos.

Así se define en esta Constitución la Nación española. Estando integrada por los Estados de:

Andalucía Baja,

Aragón,

Asturias,

Baleares,

Canarias,

Castilla la Nueva,

Castilla la Vieja,

Cataluña,

Cuba,

Extremadura,

Galicia,

Murcia,

Navarra,

Puerto Rico,

Valencia

y Regiones Vascongadas.

Mientras que


las islas Filipinas,

de Fernando Póo,

Annobón,

Corisco,

y los establecimientos de África,

eran territorios que, a medida de sus progresos, se convertirían en Estados con sus propios poderes públicos.
