La primera Constitución de México data de 1824, pero antes, en plena lucha por la independencia, se redactó la Constitución de Apatzingán, en 1814, que si bien no llegó a entrar en vigor, sí expresaba los ideales de la nueva nación. Las raíces ideológicas de ambas constituciones se encuentran en la Constitución de Cádiz (1812).

La independencia que proclamó Agustín Iturbide en 1821, se hizo bajo los presupuestos de:


El Plan de Iguala, del 24 de febrero de 1821, que establece que la forma de gobierno será una monarquía moderada.

Luego, en 1823, el Congreso Revolucionario disolvió la monarquía. La primera constitución que rigió en México es esta Constitución de 1824, mediante la cual se adopta la forma de república federal. Bajo la presidencia de Antonio López de Santa Anna se promulgaron las Siete Leyes de 1835, que fundamentan luego Las Bases Orgánicas de la República Mexicana, de 1843. Buscan crear un gobierno centralista. En 1847 se regresa a los principios de la Constitución de 1824.

La Reforma Liberal de 1855 de Benito Juárez da lugar a la Constitución de 1857. Más tarde, la Revolución Mexicana de 1910 inicia un nuevo periodo de transición que culmina con la Constitución de 1917, que es la actual Constitución mexicana, aunque incluye sucesivas reformas que actualizaron sus disposiciones (el derecho al voto de las mujeres de 1953, o las reformas electorales de 1969 y 1996, entre otras).
