La reprise de concepts tels que la démocratie, l'État de droit, la Constitution, le contrôle de constitutionnalité, etc. ... a certes témoigné d'une même philosophie d'organisation du pouvoir chez les constituants d'Afrique noire francophone et la Vè République mais s'est avérée insuffisante à contenir les velléités que peuvent alimenter la volonté de se retrouver ou de se maintenir au sommet de l'État. La Constitution en est alors sous-évaluée en dépit de la part belle que lui réserve la vision Kelsenienne. La soumission du pouvoir à la Constitution est, de plus en plus, remise en cause par des pratiques à l'orthodoxie douteuse et au soubassement purement politicien. L'intérêt général et l'idée de collectivité que devait, en principe, sous-entendre l'État seront mis à rude épreuve par la farouche détermination d'une grande portion de chefs d'États d'Afrique noire francophone à titiller à leur guise les sacro-saints attributs constitutionnels. Cela prendra, par-ci, la forme d'une personnalisation (pour ne pas dire d'une personnification) du pouvoir, et par là, les allures d'une démocratie parfaitement normale mais cachant un Parlement plus politicien que politique (au sens de gestion de la cité). Dès cet instant, la majorité parlementaire devient une redoutable machine à avaler (vis-à-vis de l'opposition) et à avaliser (à l'égard des actes posés par le Président de la République).

JOSEPH William Insa SADIO Né le 20 Octobre 1983 à Dakar (Sénégal). Doctorant-Chercheur à la Faculté des Sciences Juridiques, Politiques et Sociales de l'Université Lille 2 (France). Ancien étudiant aux Universités Gaston Berger (Saint-Louis) et Cheikh-Anta Diop (Dakar). Décédé le 11 Mai 2017, à l'âge de 33 ans, des suites d'une courte maladie. Cet Ouvrage est le fruit du Mémoire de Doctorat en Droit Constitutionnel qu'il s'apprêtait à soutenir. Nous le publions en témoignage de sa vision pour l'Afrique, comme contribution à l'édification de nos Peuples.
