Es schützt die Güter jedes Einzelnen, wofür unter anderem die Sanktionierung von Verhalten, welches dem gesellschaftlichen Zusammenleben schädlich ist, notwendig ist. Wer gegen ein Gesetz verstö t, begeht eine Straftat. Die Strafverfolgung ist allein Aufgabe der öffentlichen Organe. Es ist allerdings nicht möglich, jeder Straftat nachzugehen. Aus diesem Grund sowie gegenbenfalls persönlichem Interesse an der Strafverfolgung macht der Gesetzgeber mit dem 127 I StPO eine Ausnahme vom staatlichen Gewaltmonopol. Während die StPO in der Regel prozessuale Verfahren und Aufgaben von Amtsträgern regelt, verleiht die Norm jedem Menschen das Recht, einen anderen bei der Begehung einer Straftat zu verfolgen und vorübergehend festzunehmen. Es wird somit der Eingriff in die Rechtsgüter des Täters gerechtfertigt. Dem Bürger wird eine öffentliche Aufgabe übertragen, der er nachkommen kann, aber nicht muss. Im Folgenden wird der 127 I StPO nach seinen einzelnen Tatbestandsvorraussetzungen aufgegliedert und analysiert. Dabei wird insbesondere auf die Frage der Auslegung der Norm im Falle einer irrtümlich angenommenen Straftat eingegangen. Ebenso steht die vom Gesetzgeber geschaffene Motivation zur Beteiligung an der Strafverfolgung im Konflikt mit der Schutzbedürftigkeit des Festgenommenen. Daher wird der Umfang der gestatteten Mittel zur Festnahme - unter Berücksichtigung der Verhältnismä igkeit und Grundrechte des anderen - genauer betrachtet.
