Zum 1. Januar 1989 ist das Gesetz zur Strukturreform im Gesundheitswesen (Gesundheits-Reformgesetz - GRG) yom 20. Dezember 1988 (BGBI. I S. 2477) in Kraft getreten; durch dessen Art. 1 ist das Recht der Gesetzlichen Krankenversicherung im Sozialgesetzbuch - Fiinftes Buch (SGB V) neu geordnet und den gewandelten Anforderungen angepaBt worden. Das bislang im wesentlichen in den 368-368t und 525c RVO enthaltene Kas senarztrecht ist in die 72-106 SGB V iibernommen worden: wichtige inhaltliche Vedinderungen sind die einjahrige Vorberei tungszeit als Zulassungsvoraussetzung fUr Kassenarzte, die Kon kretisierung der Wirtschaftlichkeitspriifungen, die Uberpriifung arztlicher Abrechnungen auf RechtmaBigkeit, die Zusammenfas sung der Beteiligung und Ermachtigung von Arzten zur Teilnah me an der kassenarztlichen Versorgung in Form der Ermachti gung, der AusschluB der Zulassung oder Ermachtigung von Arzten, die das 55. Lebensjahr vollendet haben, sowie eine Vereinfachung des Schiedswesens. Von dies en Anderungen abge sehen, ist das Kassenarztrecht der Reichsversicherungsordnung aber unangetastet geblieben; es wird in seiner Auslegung durch Rechtsprechung und Literatur auch forthin von Bedeutung bleiben. Das der Arzteschaft und der rechtsanwendenden Offentlichkeit vorgelegte opusculum weist Rechtsprechung und Literatur fUr den Zeitraum 1. 1. 1979-22. 9. 1989 umfassend nach; angekniipft wird an eine Veroffentlichung des Ver/assers in NJW 1989, S. 2926ff. Mit Blick auf die Neuordnung des Rechtes der Gesetzlichen Krankenversicherung durch das SGB V ist die Darstellung der Gesetzgebungstatigkeit auf die "groBen Linien" beschrankt wor den."
