Das Oberste Rückerstattungsgericht in Herford war eine der zentralen Institutionen und wesentlichen Bestandteile der Wiedergutmachung nationalsozialistischen Unrechts in Deutschland nach dem Zweiten Weltkrieg. Als oberste Instanz in Rückerstattungssachen für das Gebiet der vormaligen Besatzungszonen der drei alliierten Westmächte hatte es letztinstanzlich zu entscheiden in allen gerichtlichen Verfahren, in denen es um die Rückerstattung von Vermögen ging, das im Dritten Reich "in der Zeit vom 30. Januar 1933 bis 8. Mai 1945 aus Gründen der Rasse, Religion, Nationalität, Weltanschauung oder politischen Gegnerschaft gegen den Nationalsozialismus" (Art. 1 Abs. 1 S. 1 USREG) weggenommen bzw. zwangsweise weggegeben worden war.

Dem Einfluss verschiedener Rechtssysteme verdankt das Gericht mehrere - insbesondere für Gerichte in Deutschland - au ergewöhnliche nichtrichterliche Angehörige und Einrichtungen sowie eine heterogene Zusammensetzung seiner Richterschaft mit deutschen Richtern, mit Richtern der Drei Mächte und mit den als Senatspräsidenten den Vorsitz in den Senaten führenden Richtern, die keiner der beiden ersten Gruppen angehören durften. Dabei stand der Beteiligung deutscher Richter an der Rechtsprechung der obersten Instanzen in Rückerstattungssachen zunächst das Misstrauen der alliierten Mächte entgegen, sie wurde letztlich aber aufgrund schlichter Praktikabilitätserwägungen umgesetzt.
