BGB zustande kommt. Weiterhin ist zu beurteilen, ob das Einstellen eines Versteigerungsgegenstandes auf der Webseite eines Internet-Auktionshauses durch den Anbieter oder das Auktionshaus selbst als eine invitatio ad offerendum oder ein bindendes Angebot zu klassifizieren ist. Die Konsequenzen dieser Einordung ist insofern weit-reichend, da der Anbieter bei der Klassifizierung als invitatio ad offerendum nicht zur Annahme des Höchstgebotes verpflichtet ist. Ferner ist zu prüfen, ob die Willenserklärung des Anbieters dem Bestimmtheitserfordernis entspricht und zu welchem Zeitpunkt der Zugang der Willenserklärungen zu bejahen ist. Besonderheiten beim Kaufvertragsabschluss bei einer Internet-Auktion könnten sich durch den vorzeitigen Abbruch durch den Anbieter oder bei beschränkter Geschäftsfähigkeit des Bietenden ergeben. Vor 30 Jahren wurden Kaufverträge typischerweise beim Bäcker, in Geschäften oder auf Flohmärkten geschlossen. Seit mehreren Jahren rückt jedoch das Internet immer mehr in den Mittelpunkt. Bevor man sich heutzutage stundenlang auf einen Flohmarkt stellt, werden die Verkaufsgegenstände lieber auf Internet-Plattformen zur Ersteigerung angeboten. Im Jahre 2000 musste schlie lich das LG Münster erstmalig über den Vertragsabschluss bei Internet-Auktionen entscheiden.
