Die Vertragsbeziehung zwischen bildenden Künstlern und Galeristen darf als einer der letzten Bereiche des Wirtschaftslebens gelten, der bis heute von rechtlicher Seite kaum Beachtung gefunden hat. Ein wichtiger Grund hierfür mag der im Kunsthandel weit verbreitete Vorbehalt gegenüber schriftlichen Vereinbarungen sein. Ausgehend von der Vertragspraxis werden in dieser Arbeit die im Kunsthandel am häufigsten vorkommenden Vertragstypen untersucht.
Den Schwerpunkt der Untersuchung bildet der Ausstellungsvertrag, der die Ausstellung und den Verkauf von (meist unveröffentlichten) Werken der bildenden Kunst und der Fotografie zum Gegenstand hat. Da Galeristen und Künstler meist in einer dauerhaften Geschäftsbeziehung stehen, werden auch exklusive Kooperationsverträge auf ihre Zulässigkeit überprüft. Die Arbeit schlie t mit einem Überblick über die urheberrechtlichen Interessen, die bei Künstlerverträgen regelmä ig betroffen sind.

About The Author

Der Autor: Gabor Mues wurde 1973 in München geboren. Von 1993 bis 1998 Studium der Rechtswissenschaften in München und Berlin (FU). 2000-2001 Masterstudiengang an der University of Oxford (Magister Juris). Seit November 2001 ist der Autor Rechtsreferendar am Kammergericht in Berlin.
