Aufgrund der EG-Richtlinie zur Koordinierung des Handelsvertreterrechts vom 18.12.1986 wurde am 23.10.1989 ein Gesetz zur Verbesserung des Schutzes des Handelsvertreters erlassen. Unter anderem wurde die Kündigungsfrist des Handelsvertreters verlängert. Eine sachliche Änderung des Handelsvertreterrechts ist jedoch nicht erfolgt. Der Gesetzgeber hat mit 84 HGB eine gesetzliche Definition des Handelsvertreters geliefert, die allgemeingültig ist und bei der Abgrenzung zu anderen Vertriebsstrukturen, sowie des unselbstständigen Handelsvertreters helfen soll. Die Begriffsdefinition hat bedeutenden Einfluss auf das Arbeits- und Sozialrecht, ebenso auf das Steuerrecht. Die Abgrenzung zu den anderen Personen, die für einen Unternehmer im Bereich des Vertriebs tätig werden, ist von gro er Bedeutung und führt noch immer zu neuen Rechtsstreitigkeiten. Auch die zunehmende Globalisierung und die einhergehende Möglichkeit, als Handelsvertreter in Europa für einen Unternehmer mit Firmensitz au erhalb der EU tätig zu werden, sorgt für interessante Rechtsprobleme und -fragestellungen. Es bleibt zu erwarten, wie die Gesetzgebung in Deutschland und Europa auf die entstehenden Sachverhalte reagiert. Ungeachtet dessen muss man den Begriff des Handelsvertreters erst definieren und darauffolgend von den anderen Vertriebsstrukturen abgrenzen.
