Die Arbeit nähert sich dem in der National Security Strategy der USA von 2002 entworfenen Konzept der preemptive self-defense gegen weltweit operierende Terrorbanden und Schurkenstaaten vor dem ideengeschichtlichen Hintergrund des Präventivkrieges. Den Anlass hierzu liefert das als Bush-Doktrin bekannt gewordene Dokument selbst, indem es dieses weit verstandene Selbstverteidigungsrecht in eine Traditionslinie mit dem Völkerrecht vergangener Jahrhunderte stellt. Die erste, in die Vergangenheit gewandte Fragestellung der Untersuchung lautet daher, ob es in der völkerrechtlichen Beurteilung der präventiven Kriegsführung eine Kontinuität gibt, die sich von der Gegenwart bis zu den Anfängen der modernen Völkerrechtswissenschaft zurückverfolgen lässt. Ausgangspunkt ist dabei das Werk des Niederländers Hugo Grotius, dessen im Jahr 1625 veröffentlichte Schrift De iure belli ac pacis libri tres als prominenteste Äu erung eines frühneuzeitlichen Völkerrechts gilt. Der Antwort schlie t sich eine zweite, nun in die Zukunft gerichtete Frage an: Fügt sich ein Recht auf preemptive self-defense in diese Kontinuität ein oder bricht es mit ihr?

About The Author

Der Autor: Martin Kunde, geboren 1977 in Essen, studierte von 1997 bis 2003 Rechtswissenschaft in Marburg, Tours (Frankreich) und Würzburg. Anschließend war er für zwei Jahre Wissenschaftlicher Mitarbeiter am Lehrstuhl für Völkerrecht, allgemeine Staatslehre, deutsches und bayerisches Staatsrecht und politische Wissenschaften der Universität Würzburg. Dort absolvierte er auch ein Postgraduierten-Studium im Europäischen Recht. Seit 2006 ist der Autor Rechtsreferendar am Landgericht Mönchengladbach.
