Die Stiftung von Todes wegen bietet dem Erblasser die einzigartige Möglichkeit, einen Erben nach seinen Vorstellungen zu kreieren. Gleichwohl ist die Stiftungserrichtung von Todes wegen in der Vergangenheit ins Abseits geraten. Die Rechtslage, insbesondere das Konzessionssystem, erzeugte vielfältige Unsicherheiten, die einer sicheren erbrechtlichen Planung abträglich waren. Von daher wurde in der Kautelarpraxis von dieser Form der Stiftungserrichtung überwiegend abgeraten. Mit dem Gesetz zur Modernisierung des Stiftungsrechts von 2002 wollte der Gesetzgeber das Stiftungsrecht insgesamt transparenter gestalten. Ausgehend von einer rechtshistorischen Betrachtung untersucht der Verfasser die sich im Zusammenhang mit der Stiftungserrichtung von Todes wegen ergebenden Fragen unter besonderer Berücksichtigung der Auswirkungen des Gesetzes zur Modernisierung des Stiftungsrechts.

About The Author

Der Autor: Markus Schewe wurde 1972 in Duisburg geboren. Er studierte an der Universität Bochum Rechtswissenschaften und schloss das Studium 1998 mit der Ersten juristischen Staatsprüfung ab. Im Anschluss daran war er Wissenschaftlicher Mitarbeiter am Lehrstuhl für Bürgerliches Recht, Handelsrecht und Deutsche Rechtsgeschichte an der Juristischen Fakultät der Universität Bochum. In dieser Zeit absolvierte der Autor auch das Referendariat und legte 2003 das Zweite juristische Staatsexamen ab. Seitdem ist er als Rechtsanwalt in Essen tätig.
