Nach Kriegsende war die auf Schutz und Konservierung des Bestehenden gerich- tete Handelsgesetzgebung des nationalsozialistischen Regimes in Westdeutschland zunächst grundsätzlich in Geltung geblieben, wenn sie auch allmählich gelod!: ert oder weniger streng gehandhabt wur, de. Die Aufrechterhaltung der Bindungen war angesichts des Warenmangels fürs erste wahrscheinlich die beste Lösung. Die Zu- lassung neuer Betriebe blieb weitgehend in das Ermessen der Verwaltungsbehörden gestellt; insbesondere blieb es auch unter den sog. Lizenzierungsgesetzen in den Ländern des amerikanischen Besatzungsgebiets bei der Prüfung des .. volkswirt- schaftlichen Bedürfnisses" für Betriebe, die gegründet werden sollten. Doch wurde die Handhabung der Zulassungsbestimmungen in diesem Punkt zuerst erleichtert. An dem Nachweis der Sachkunde und der pel'Sönlichen Zuverlässigkeit wurde aber festgehalten. Die Behörden hielten es lange Zeit für notwendig, da diese Schleuse, die den Zugang neuer Betriebe zum Handel kontrollierte, bestehen blieb, ganz ab- gesehen davon, da die Vertretungen des Handels, wie leicht zu verstehen ist, eine solche Regelung forderten und auch heute noch fordern. Im Laufe der Zeit hat sich aber auch in dieser Beziehung eine 'sehr starke Lod!: erung durchgesetzt. Der mit der Währungsreform vollzogene Wechsel der Wirtschaftspolitik, der übergang von der Zentralverwaltungs-zur Marktwirtschaft, stellte auch für den Handel einen wichtigen Wendepunkt dar, wenngleich noch für geraume Zeit die Verkäufermärkte in weiten Bereichen der Wirtschaft fortbestanden und die Wa- rennachfrage grö er war als das Angebot. Aber die Produktion erweiterte sich nach Art und Menge Schritt für Schritt, so da , der Absatz des Handels rasch zunahm.
