Spätestens seit der gro en Zuwanderungswelle muslimischer Migranten in den letzten Jahren gerät der Islam und gelebter Islam in all seinen Facetten, und eben auch die Ehe unter Muslimen, in den Fokus. Aufgrund dieser Betrachtung stellt sich die Frage, wie die Ehe unter Muslimen oder im Islam geregelt ist. Um eine objektive Untersuchung der Leitfrage vorzunehmen, wird von der Ehe im Islam als rein zivilrechtlicher Vertrag ausgegangen. Nachdem die Grundlagen der islamischen Normenlehre und deren Entwicklung einleitend beschrieben werden, werden die Kriterien eines gültigen Ehevertrags dargestellt. Anschlie end werden zwei Arten neben der monogamen Ehe aufgezeigt, bevor auf innereheliche Aspekte eingegangen wird. Danach werden die rechtlichen Aspekte der Scheidung im Islam veranschaulicht und Argumente für und gegen die These, der islamische Ehevertrag sei rein zivilrechtlicher Natur, gegenüberstellt, bevor abschlie end ein Fazit gezogen wird.
