Inhaltsangabe: Problemstellung: Modern und In ist es derzeit schon, vom internationalen Recht und einer globalen Rechtsordnung zu reden. Die Vereinten Nationen, die Europäische Union, die Weltbank, die Welthandelsorganisationen, internationale Sportverbände sowie der Internationale Währungsfond sind die Spitze einer erfolgreichen Globalisierung. Doch arbeiten diese Institutionen in ihrem Rahmen einer „globalen Rechtsordnung" und eines „internationalen Rechts" bereits au erordentlich erfolgreich. Manch einer könnte an dieser Stelle anmerken, dass diese Rechtsordnung nichts anderes ist, als der schon seit Jahrzehnten bekannte Modus der Rechtsauslegung und der Rechtsvergleichung, garniert mit den Normen des internationalen Privatrechts oder ggf. der UN-Kaufrechtskonvention. Warum also ein globales Recht schaffen? Mythos, Phantom oder Hirngespinst sind Begriffe, die an einer Existenz der lex mercatoria zweifeln lassen. Internationale Verträge wie Lando, UN-Kaufrechtskonvention oder UNCITRAL, anerkannte Prinzipien der UNIDROIT oder der Internationalen Handelskammer, das seit langem existierende Internationale Privatrecht (IPR), aber auch die jahrzehntelange Schiedsgerichtspraxis verstärken den ersten Eindruck und werfen die Frage nach Entstehung, Entwicklung und Eingliederung einer lex mercatoria auf. Das Ziel dieser Arbeit ist die Antwort auf die Frage, ob die lex mercatoria eine Basis für ein Weltrecht ist. Dazu wird diese Arbeit Beschreibungen und Definition von Globalisierung, Recht, Weltrecht und lex mercatoria liefern und diese untereinander in Beziehung setzten. Aufbauend auf dem Begriff Konzern und Macht wird das Phänomen Globalisierung erklärt. Es sollte eine Notwendigkeit nach einem globalen Recht oder einer Rechtsordnung gesehen werden. Danach wird das Theoriekonstrukt einer positiven Rechtslehre und einer systemtheoretischen Rechtslehre erklärt und gegenseitig abgewogen. Das vierte Kapitel fragt nach „Quasi-Recht", also nach Rechtsquellen ohne staatlichen
