Vorwort Judikative Macht wird ausge bt, wenn Gerichtsurteile ber die legitime Geltung e- kutiver und legislativer Akte befolgt werden. Judikative Macht setzt damit zun chst zweierlei voraus: Zum einen lassen sich die Handlungen und Entscheidungen der E- kutive und Legislative an etwas bemessen, das ihnen wie eine Verfassung normativ vorangeht. Zum anderen setzt die Macht der Judikative voraus, dass die Entscheidung ber die Vereinbarkeit mit einer derart normativ vorrangigen Verfassung schlie lich auch einer Verfassungsgerichtsbarkeit obliegt. W re die Bedeutung der Verfassung allerdings stets eindeutig oder k nnte sie anderweitig ihre Bedeutung kontrollieren, dann lie e sich unter diesen beiden Voraussetzungen noch nicht von einer Macht der Judikative sprechen. Stattdessen handelte es sich genau genommen um die Macht der Verfassung, die durch die Verfassungsgerichtsbarkeit ausgef hrt wird. Die Macht der Judikative er ffnet sich deshalb erst unter einer dritten, hinreichenden Voraussetzung: der Unverf gbarkeit der gedeuteten Verfassung ber ihre Bedeutung. Erst unter dieser Bedingung wird aus dem blo den Verfassungssinn vollstreckenden Verfassungs- richt eine souver n ber ihre Bedeutung entscheidende Instanz. Die Macht der Judi- tive muss insofern als Deutungsmacht spezifiziert werden. Deren Komplexit t, so m- ne erste zentrale These, l sst sich jedoch erst dann analytisch erschlie en, wenn d- entsprechend genau zwischen den Ebenen der gedeuteten Verfassung, des deutenden Gerichts und der Deutung selbst unterschieden wird. Obwohl die Judikative auf diese Weise also Deutungsmacht aus ben kann, besitzt sie keine Macht. Denn die Macht der Judikative existiert nur im Moment ihres Vo- zugs. Die judikative Deutungsmacht ist deshalb immer eine Frage der Praxis.
