März 2004 verhängte die Europäische Kommission eine Rekordgeldbu e von 497 Millionen Euro gegen Microsoft . Dem amerikanischen Softwarehersteller wurde vorgeworfen, gegen Art. 82 EG versto en zu haben, indem er seine marktbeherrschende Stellung auf dem Markt für PC-Betriebssysteme missbräuchlich ausnutzte, um seine Marktanteile auf dem Markt für Server-Betriebssysteme auszubauen. Microsoft verweigerte konkurrierenden Serverbetriebssystem-Produzenten notwendige Schnittstelleninformationen zu seinem Betriebssystem Windows XP. Des Weiteren koppelte Microsoft sein Betriebssystem an den vorinstallierten und nicht deinstallierbaren Windows Media Player, um durch diese Strategie seine Marktmacht auf dem Markt für PC-Betriebssysteme auch auf den Markt der Streaming Media Player zu hebeln. Die Klage, die Microsoft gegen die Kommissionsentscheidung vor dem EuG erster Instanz in Luxemburg einlegte, wurde am 17. September 2007 nach einer spektakulären und vom Softwaregiganten minutiös durchinszenierten Anhörung, zu der Microsoft unter anderem ein sechzigköpfiges Team allein aus den Vereinigten Staaten anreisen lie , abgewiesen . Erst jetzt setzte Microsoft die Abhilfema nahmen der Kommission auch wie gefordert um. Doch dieser Verzug führte schlie lich dazu, dass Microsoft im Februar 2008 von den europäischen Wettbewerbshütern eine weitere Rekordgeldbu e in Höhe von diesmal gar 899 Millionen Euro auferlegt wurde. Auch wenn die Höhe der Geldbu en im Vergleich zu bisherigen von der Kommission erhobenen Geldbu en "völlig aus dem Rahmen fallen", hatten sie in Relation zu einem Weltumsatz Microsofts von Juli 2002 bis Juni 2003 von über 31 Mrd.
