Derzeitig befinden sich über 2000 digitale "Währungseinheiten" im Umlauf. Die mit Abstand Wertvollste unter ihnen ist der Bitcoin mit einem Marktwert von ungefähr $ 68,097 Mrd. Entwickelt unter dem Pseudonym "Satoshi Nakamoto" erschien bereits 2008 in einem gleichnamigen Aufsatz die Idee ein privates Geld zu erschaffen, dass sich mittels digitaler Dezentralität in einem Peer-to-Peer Netzwerk dem Einfluss von Finanzinstitutionen entzieht. War diese "Währung" zu Beginn noch recht unbekannt, so wird sie heute aufgrund schnellerer Transaktionszeit, geringeren Transaktionskosten und Anonymität gegenüber herkömmlichen Zahlungsmethoden zunehmend als "Zahlungsmittel" angeboten und akzeptiert. So erzeugte der Bitcoin nicht zuletzt durch einen neuen Höchstwert von über 20.000 Dollar pro Bitcoin Ende 2017 weltweites Aufsehen. Mit der zunehmenden Verwendung im Warenwirtschaftsverkehr als "Geld" sowie seiner sogenannten "Dezentralität" stellt sich immer mehr die Frage, wie Bitcoins privatrechtlich einzuordnen sind. Bevor diese Problematik im Folgenden einer Lösung zuge-führt kann, muss zunächst geklärt werden, was unter dem Begriff Bitcoin genau zu verstehen ist.
