Trierer Weinversteigerung. Er dient als klassischer Fall dazu, das seit jeher umstrittene Problem des fehlenden Erklärungsbewusstseins im Zusammenspiel mit Willenserklärungen zu illustrieren. Diese Frage fehlenden Erklärungsbewusstseins ist aber nicht die einzige, die sich im Zusammenhang mit den subjektiven Merkmalen der Willenserklärung stellt. Neuerdings wird ein subjektiver Tatbestand der Willenserklärung völlig abgelehnt, sodass selbst der Handlungswille nicht mehr notwendiges Merkmal der Willenserklärung zu sein scheint. Dass es sich aber bei diesen Problematiken um nicht nur theoretisch, sondern auch praktisch bedeutsame handelt, zeigt ein Grundsatzurteil des BGH, in dem es von den subjektiven Elementen, konkret dem Erklärungsbewusstsein, einer Willenserklärung abhing, ob die erklärende Bank von vornherein mangels tatbestandlicher Willenserklärung nicht gebunden war, oder ob es auf die Wirksamkeit einer Anfechtung ankam. Die Einigkeit über den Begriff, das Wesen und den Tatbestand der Willenserklärung ist nur eine scheinbare, sind die Details doch umstritten. Die Frage nach den subjektiven Merkmalen der Willenserklärung ist in erster Linie eine Frage des tatbestandlichen Vorliegens einer Willenserklärung als solcher, mithin des subjektiven Tatbestands. Sie berührt naturgemä aber auch weitergehende Fragen, nämlich nach den Rechtsfolgen eines Fehlens der subjektiven Merkmale. Diese Fragen reichen in ihren Wurzeln noch in die Zeit vor dem BGB zurück und haben sich bis in die heutige Zeit zu einem vielbehandelten, geradezu klassischen Thema entwickelt.
