Im Zentrum der Arbeit steht die Frage der Unrechtsbegründung für die Verbrechensverabredung als Grundform der Komplottstrafbarkeit und Vorfelddelinquenz als einem der problematischsten Bereiche der Strafbegründung. Im Kern geht es um die Bestrafung eines Tatplanes ohne Ausführungshandlung und dem damit gestellten Problem, ob ein solcher Tatbestand von einem Gesinnungsstrafrecht unterschieden werden kann. In diesem Zusammenhang werden allgemeine Lehren der Unrechtsbegründung untersucht, zunächst funktionale Ansätze, die sich ausschlie lich am Präventionsgedanken orientieren, sodann werden nach Ablehnung rein funktionaler Ansätze die eigentlichen Voraussetzungen des Kriminalunrechts herausgearbeitet. An der so entwickelten Bestimmung des Kriminalunrechts orientiert wird die Frage nach der Strafbarkeit des unausgeführten Komplotts auf den Begriff des abstrakten Gefährdungsdeliktes bezogen. Das negativ-kritische Resultat lautet, dass die blo e Verbrechensverabredung als Straftatbestand nach strafrechtlicher Begrifflichkeit, aber auch aus verfassungsrechtlicher Sicht unhaltbar ist. Nicht nur zur Komplettierung, sondern auch in einem inneren Bezug zu der Frage der Unrechtsbegründung stehen die Darstellung der historischen Entwicklung des Tatbestandes der Verbrechensverabredung wie auch die Erörterungen zu Anwendungsfragen der geltenden Rechtslage.

About The Author

Der Autor: Ulrich Fieber wurde 1971 in Berlin geboren. Von 1990 bis 1995 studierte er Rechtswissenschaften an der Universität Hamburg und schloss das Studium am 08. September 1995 vor dem Hanseatischen Oberlandesgericht in Hamburg ab. In den Jahren 1996 bis 1999 leistete er seinen Vorbereitungsdienst in Hamburg, welchen er am 05. März 1999 mit dem Zweiten Juristischen Staatsexamen vor dem Hanseatischen Oberlandesgericht Hamburg abschloss. Seit dem 01. Juli 1999 ist der Autor als Richter des Bundeslandes Schleswig-Holstein tätig. Promotion 2000.
