Auch ein mögliches Organisations-, Auswahl- oder Überwachungsverschulden des Verwalters ist in Betracht zu ziehen. Weiters ist nach dem in der jeweiligen Situation und Konstellation gebotenen Sorgfaltsma stab hinsichtlich der Verrichtung des Winterdienstes zu fragen. Durch Heranziehen von Fachartikeln, Entscheidungen des OGH und Rechtssätzen werden die aufgeworfenen Fragestellungen abgehandelt. Bei einem entstandenen Schaden aufgrund unzureichend durchgeführten Winterdienstes ergeben sich haftungsrechtliche Problematiken und Fragestellungen. Es wird in dieser Seminararbeit betrachtet, aufgrund welcher gesetzlichen Grundlagen und in welchem Ausma die Wohnungseigentümergemeinschaft auf den mit ihrer Liegenschaft in Zusammenhang stehenden Wegen für die Durchführung von Winterdienstarbeiten wie Schneeräumung und Verwendung von Streumitteln zu sorgen hat. Als gesetzliche Regelungen für die Besorgung des Winterdienstes lassen sich 93 Stra enverkehrsordnung (StVO), aufgrund der 93 Abs 4 und 94 d Z 18 StVO ergangene ortspolizeiliche Verordnungen einer Gemeinde und die Wegehalterhaftung nach 1319a ABGB heranziehen. Zudem ist zu fragen, ob und welche vertraglichen Beziehungen zwischen der Wohnungseigentümergemeinschaft, dem Verwalter und der geschädigten Person vorliegen und welche Rolle die Übertragung der Winterdienstarbeiten auf ein Fremdunternehmen spielt. Von der Übertragung der Schneeräum- und Streuarbeiten auf ein Fremdunternehmen abzugrenzen ist auch die Erledigung dieser durch einen als Hausmeister angestellten Wohnungseigentümer.
