Le droit de la santé entretient avec le droit à la santé des relations complexes. Dans son interprétation objective, le droit à la santé s'affirme comme le nouveau fondement du droit de la santé. Si sa positivité est peu affirmée, elle reçoit une protection indirecte de la part du principe de respect de la dignité humaine et de la jurisprudence de la Cour européenne des droits de l'homme. Cette protection médiate et la forte revendication sociale en faveur de sa reconnaissance ont un impact déjà important sur le droit de la santé.
