Im Rahmen der gesellschaftlichen Kommunikation haben satirische bzw. vermeintlich satirische Beiträge in den letzten Jahren insbesondere in den deutschsprachigen Ländern einen wachsenden Stellenwert bekommen. Dabei bewegt sich diese Art der Auseinandersetzung grundsätzlich in einem Raum von widerstreitenden Interessen, führt nicht selten zu einer Kollision zwischen Meinungs- und Kunstfreiheit auf Seiten des Satirikers sowie der Ehre auf Seiten des Betroffenen. Die Arbeit soll dazu beitragen, diese Kollision werkadäquat aufzulösen. Ziel ist es, anhand eines Vergleichs der vier Rechtssysteme (Deutschland, Österreich, Schweiz sowie - dem Mutterland des Satirischen - England) einen Weg zu einer angemessenen juristischen Beurteilung satirischer Werke aufzuzeigen und die bisherigen Unklarheiten und Mängel darzulegen, auf dass die Aussage Eckhard Henscheids in der Times vom 3. August 1991, Just imagine a (...) court dealing with linguistics and satire; it will be one of the funniest cases for years, zumindest zukünftig nicht mehr zutreffen sollte.

About The Author

Die Autorin: Katja Kassing wurde 1976 in Oberhausen/Rheinland geboren. Von 1996 bis 2000 studierte sie Rechtswissenschaften an der Universität Münster. Dort war sie als studentische sowie nach dem ersten Staatsexamen auch als wissenschaftliche Hilfskraft tätig. 2001 wurde sie als Stipendiatin in das Programm des von der Deutschen Forschungsgemeinschaft (DFG) finanzierten Graduiertenkollegs Europäischer Persönlichkeitsrechtsschutz der Ludwig-Maximilians-Universität München aufgenommen. In München, Zürich, Salzburg und Oxford entstand ihre Dissertation. Die Autorin absolviert seit 2003 ihren juristischen Vorbereitungsdienst im OLG Bezirk Düsseldorf.
