Des Weiteren ergeben sich wirtschaftliche Konsequenzen, die für die betroffenen Regionen häufig existenzbedrohend sind. Die entstandenen Kosten werden letztlich über Energie- oder Produktpreise, Steuern und Abgaben an den Verbraucher weitergegeben. Infolge des verstärkten Imports bzw. Exports von Öl und des dadurch bedingten erhöhten Schiffsverkehrs, sanken nach Angaben von Greenpeace Gruppe Aachen zwischen den Jahren 1963 und 1996 insgesamt 686 Tanker. Latente Kollisionen, Sturmschäden, Materialermüdungen etc. werden auch künftig an dieser Bilanz nichts ändern. Insofern stellt sich die Frage, wer im Falle einer Havarie verantwortlich für die Begleichung der Kosten ist bzw. ob und wenn ja welche Fondsmittel dafür zur Verfügung stehen. Den rechtlichen Rahmen für den Umgang mit Abfällen in der Europäischen Gemeinschaft stellt mittlerweile die RL 2008/98/EG über Abfälle und zur Aufhebung bestimmter Richtlinien dar. Kommt es nun zu einer Havarie und infolgedessen zu einer Verschmutzung bzw. Kontaminierung der Umwelt durch Öl, dann ist zu prüfen, ob es sich hierbei um Abfall i. S. d. ma geblichen Richtlinie der EG handelt und ferner, von wem die Kosten für die Beseitigung der Abfälle zu tragen sind. Mit diesen Fragen hat sich der EuGH beschäftigt und am 24.06.2008 das Urteil Commune de Mesquer (Az.: C-188/07) gefällt. Die Arbeit gibt zunächst einen kurzen Überblick über Versicherungen und ma gebliche internationale Übereinkommen, die die Haftung und Entschädigung im Falle von Ölverschmutzungsschäden regeln. A
