Inhaltsangabe: Zusammenfassung: Im Zuge der immer grö eren Globalisierung der Wirtschaft und deren Auswirkungen auf österreichische Unternehmen sind geographische Angaben von wachsender wirtschaftlicher Bedeutung. Ein immer grö eres Qualitätsbewu tsein und immer höhere Qualitätsansprüche des Konsumenten führen zu einer immer stärkeren Nachfrage nach Produkten gewisser geographischer Herkunft und daher zu immer grö eren Interessen der Ursprungsländer am Schutz ihrer geographischen Angaben. Doch ist das wirtschaftliche Potential der geographischen Angaben noch lange nicht erschöpft, und deshalb ist heute ein wirksamer Schutz dieser Angaben wichtiger den je. Die Konkretisierung der Schutzfähigkeit geographischer Herkunftsangaben bereitet aber mitunter erhebliche Schwierigkeiten. Jene Hersteller, die das Produkt im geographischen Bereich erzeugen, auf den der Herkunftsangabe hinweist, wollen andere Hersteller, für die dies nicht zutrifft, von der Begriffsverwendung ausschlie en. Eine derartige Ausschlie lichkeit kann indes nur in Betracht kommen, soweit der geographische Begriff überhaupt noch als Herkunftshinweis aufgefa t wird. Die Gerichte sind also mit der Aufgabe konfrontiert, die schwierige Grenze zwischen geographischen Herkunftsangaben und Gattungsbegriffen zu ziehen. Analysiert werden in dieser Arbeit einerseits die Schutzfähigkeit geographischer Herkunftsangaben nach dem Irreführungsverbot des 2 UWG. Hierbei stehen die unterschiedlichen Erscheinungsformen der geographischen Herkunftsangabe, insbesondere unmittelbare/mittelbare Herkunftsangaben, fremdsprachige Angaben und Herkunftssymbole im Vordergrund. Auch mit dem immer öfter auftauchenden Phänomen der Umwandlung einer geographischen Herkunftsangabe in eine Beschaffenheitsangabe bzw. Gattungsbezeichnung setzt sich die Arbeit auseinander.
