Diese Arbeit befaBt sich mit einem Thema, welches nicht nur gewichtige Rechtsprobleme des Volkerrechts, des internationalen Verwaltungsrechts und des nationalen offentlichen Rechts aufwirft, die zur Zeit weltweit intensiv diskutiert werden, sondern auch durch eine schier unuberseh- bare Fulle von Praxismaterial aus dem -nach deutscher Rechtssystematik so bezeichneten -offentlichen Wirtschaftsrecht gekennzeichnet ist. Hier muBte eine Auswahl der, wie ich meine, wichtigsten Sachbereiche getrof- fen werden. Wie sich zeigt, sind die Hilfestellungen des Volkerrechts bei der BewaIti- gung der aufgezeigten Staatenkonflikte zwar bisher in der Praxis noch nicht voll ausgeschopft worden, aber sie sind in jedem Fall rur sachge- rechte Losungen unzureichend. Problemlosungen konnen nur von einem offentlichrechtlichen Kollisionsrecht erwartet werden, das aber bei der gegenwamgen Rechtslage in der Bundesrepublik Deutschland noch zu wenig entwickelt ist. Hier konnen nur -sicherlich nicht erschopfende - Ansatze aufgezeigt werden, we1che als Beginn von Uberlegungen fur eine Weiterentwicklung der nationalen wie internationalen Rechtsordnungen zu verstehen sind. Mein besonderer Dank gilt meinem verehrten akademischen Lehrer, Herm Prof. Dr. Walter Rudolf, der mir mit seinem Rat zur Seite stand und aufgrund dessen langjahriger wissenschaftlicher Forderung diese Arbeit entstand. Die Arbeit wurde im Oktober 1992 abgeschlossen. Sie wurde im Sommersemester 1993 vom Fachbereich Rechts-und Wirtschaftswissen- schaften der Johannes Gutenberg-Universitat in Mainz als Habilitations- schrift angenommen. Mein Dank gilt auch Herm Prof. Dr. Eckart Klein als Zweitkorrektor.
